Non-Compete Clause
A contractual provision that restricts a franchisee from operating a competing business during and after the franchise relationship.
Non-compete clauses are standard in franchise agreements and typically apply both during the term of the agreement and for a period after termination or expiration (often 1–2 years). The geographic scope and duration of the non-compete must be reasonable to be enforceable. These clauses protect the franchisor's proprietary systems and trade secrets. Prospective franchisees should understand the non-compete terms thoroughly, as they may limit future business options.
